At a time when religion is under attack worldwide,  it’s a hopeful sign that an American court has  stood fast  on a  basic principle.   Expect hysterical howling from the Left to follow.

Gay marriage win streak broken…

Finally,  after a long losing streak since the Supreme Court tortured itself last year  into a ruling that rejected the Defense of Marriage Act as unconstitutional,  a state judge in Tennessee  ruled last  week that  “neither the Federal Government nor another state should be allowed to dictate to Tennessee what has traditionally been a state’s responsibility.”

As in so many other cases,  gay activists used the pretext of obtaining a divorce in a state which does not recognize gay marriage to dissolve a marriage obtained in a state which does.   The federal courts continue to cave on so-called marriage equality,  though there is one before the Sixth Circuit which may end differently.

By the way,  when someone starts spouting  “marriage equality”  to me,  what I hear is that LGBT rights and the lifestyles those communities choose,  demand precedence over all else because they matter more.   What it means is tyranny by the minority.   If you want to set the cat amongst the pigeons,  ask an activist their view on marriage between more than two parties,  between relatives,  and between humans and animals.   You will find their attempts to answer interesting,  followed by even more interesting efforts to differentiate amongst them all.

Stop and frisk revived…

This is,  as VP Biden so famously said,  a BFD,  not because a federal appeals court on Thursday blocked a judge’s ruling finding the New York Police Department’s stop-and-frisk policy discriminated against minorities,  but because it took the unusual step of removing her from the case,  saying interviews she gave during the trial called her impartiality into question.

I cannot stress how unusual this is,  because courts are notoriously loath to question the impartiality of a fellow jurist,  much less remove one from a case.  The action was plainly warranted in this instance,  but it rarely happens.

Robert Bork, R.I.P.

Robert Bork  was attacked  shamelessly  and unfairly  by liberals and progressives,  who were so desperate to keep him off the Supreme Court that  they lied  through their collective teeth.  I saw him on a number of televised panels,  and he seems never to have lost his sense of humor or his ability to think rapidly and answer with brief precision.   He deserves better than being remembered chiefly for having his last name turned into a verb   —  chiefly for his ardent,  lifelong defense of the Constitution.

Here are  some remembrances which  give you  a flavor of the man.   I especially like Mario Loyola’s  “intellectual feast”  and  this sample of  some of Bork’s published works from the Wall Street Journal.

Still one sane judge…

Government under His Oneness was quick to  force a veteran  into psych evaluation because of the anti-government messages he posted on Facebook,  but The Rutherford Institute came to his defense and the judge threw out the orders because they lacked any basis or evidence.

Is this judge  so stupid that he doesn’t realize he’s being played for a fool?  If he truly believes a convicted murderer deserves a sex-change operation at taxpayer expense,  he should be drummed out of the courts and out of town as well.

Elections matter….

And if you don’t think so,  imagine what yet another round of activist progressive judges will do to us.  One district judge has just ruled  “Don’t Ask, Don’t Tell”   is unconstitutional and ordered it stopped throughout the U.S. military.

His Oneness decided Tuesday  to appeal the ruling,  but don’t assume it will be more than half-hearted,  for reasons Ed Whelan laid out a month ago,  and  more recently.
